DS@ 6 Terms and Conditions

Welcome to DS@6 Sports Inc. (“we,” “us,” “our”). By participating in our programs, accessing our website, or engaging with our content, you agree to be bound by the terms and conditions outlined below. These terms include important legal rights and responsibilities. Please read them carefully.

1. Acknowledgment of Risks

Participation in sports and activities with DS@6 involves inherent risks that may result in physical or emotional injury, property damage, or other losses. These risks include, but are not limited to:

  • Injuries arising from physical activity or equipment usage.

  • Medical conditions triggered by activity participation.

  • Damage to clothing or personal property.

Despite the use of safety measures, such risks cannot be entirely eliminated without altering the nature of the activity.

2. Voluntary Participation

By participating, you affirm that your involvement is entirely voluntary. You acknowledge and accept all risks, whether known or unknown, and assume full responsibility for your participation. If at any time you feel conditions are unsafe or believe you are unable to participate due to physical or medical reasons, you agree to discontinue participation immediately.

3. Release of Liability

You voluntarily release and forever discharge DS@6 Sports Inc., its owners, directors, officers, employees, agents, volunteers, participants, and all associated parties (“Releasees”) from any and all claims arising from negligence. This release covers claims related to injuries, damages, or other losses incurred during your participation in any DS@6 activity, event, or program.

This release does not apply to claims resulting from intentional misconduct. In the event legal fees or costs are incurred to enforce this agreement, you agree to indemnify Releasees for all such fees and costs.

4. Insurance and Medical Conditions

You confirm that:

  • You have adequate insurance to cover any injury or damage you may cause or suffer while participating in our activities.

  • You have no medical or physical conditions that would interfere with your safety during participation. If such conditions exist, you assume full responsibility for any risks or costs associated with them.

5. Disclaimers

  1. Self-Representations: Any statements made on our website or by DS@6, such as being a "winning team" or "the #1 team," reflect our observations and achievements but are not universally applicable. These claims should not be considered guarantees or assurances of results for every participant.

  2. Website Content: While we strive for accuracy in the information provided on our website, we make no guarantees regarding its completeness or reliability. Content is subject to change without notice.

6. Photography Liability and Usage

  1. Photography Waiver: By registering your child with DS@6, you consent to their inclusion in photographs or videos taken during events, games, or other activities. These images may be used for promotional purposes, including on our website and social media platforms.

  2. Opt-Out Policy: If you do not want your (or your child’s) photograph used publicly, please contact us at DSat6@gmail.com or 913-683-0211. We will promptly remove the image from our platforms upon receipt of your request.

  3. Public Event Photos: Images captured at public events are considered public domain. While we will make reasonable efforts to honor removal requests, DS@6 assumes no liability for images shared by third parties or attendees.

7. Website Safeguards and Privacy

  1. Data Security: We take reasonable precautions to protect your personal information submitted through our website. However, we cannot guarantee the complete security of electronic data transmissions. By using our website, you acknowledge and accept these risks.

10. Parental/Guardian Agreement

For participants under the age of 18, a parent or guardian must agree to these terms on behalf of the minor. By agreeing, the parent or guardian further releases Releasees from any claims of negligence brought on behalf of the minor and assumes responsibility for the minor’s participation.

11. Understanding and Agreement

By agreeing to these terms, you acknowledge that:

  • You have had sufficient time to read and understand these terms.

  • You have the option to consult legal counsel if desired.

  • Participation is offered at the stated cost in exchange for agreeing to this release, which you accept as a reasonable bargain.
